1. Rider is sole user – Operator for the rider are the only parties to this

agreement Except as expressly by the operator, the rider is the sole renter on

tour and is solely responsible for compliance with all terms and conditions

contained herein and signed waiver. You must not allow others to use mini-

segway.

2. Rider is at least 10 years old – Rider represents & certifies that Rider is at least

10 years old. Riders between the age of 10-18, is ”youth rider” either a legal

guardian and / or parents for the youth rider, & including the youth rider will both

agree and abide by the terms and conditions set forth in this document and also

waive any claims against / or hold harmless the operator.

3. Rider is competent Segway operator – Rider represents & certifies that he/she

is familiar with the operation of the mini-segway and has reviewed the

rider/safety training given 7 reviewed safety page on Vancouver wizard wheels

website. By choosing to ride on a mini-segway, Rider assumes all responsible and

risks for any injuries or medical condition. You are advised to adjust your riding

braking distance to suit surrounding area.

4. Height & Weight Limit – You must stand between 4’ 4’ & 6’ 5” tall. You must

weigh between 60 -220 lb.

5. Rider must follow & obey all laws pertaining to the use, Riding/Parking and / or

operation of the mini-segway, Including all provincial and local laws and the rules

and regulations riding on bike lanes, Including mandatory helmet laws ,Rider also

agrees to act with courtesy and respect towards others (pedestrian, cyclists,

animals, private property) while using bike lanes.

PROHIBITED ACTS

 You must not operate a mini-Segway while under the influence of any

alcohol, drugs, medication or any substance that may impair your ability to

operate a mini-Segway.

 You must not use any cellphone, portable music player, headphones,

airpods or any electrical device that may distract you from operating the

Segway safely.

 You must not place anything on the kneebars of the mini-Segway.

 You must not carry a second person or child on the mini-Segway.

 Operator recommends against operation of a Segway while carrying or

holding a bag or backpack or any item that can alter balance, add extra

weight or impair safe operation of the mini-Segway.

 The Segway must not be parked at a prohibited parking spot and be parked

on unauthorized private property or blocking the right of way or in any

other unapproved non-public space.

 Do not park the Segway in heavily pedestrian/cycle traffic areas on the bike

lanes.

Mini-Segway is intended for only limited types of use

Rider agrees that he/she will not use the mini-Segway for racing or stunt/trick

riding. Rider agrees that he/she will not use or operate the Segway on roads,

mud, sand, through water or any location that is prohibited, illegal, and/or a

nuisance to others. Rider agrees that he/she will not use the mini-Segway for hire

or reward, nor use it in violation of any law or regulation.

Reporting of damage/crashes/enforcement & violations

Rider must report any accident, crash, damage, personal injury, stolen or lost

mini-Segway to operator as soon as possible. If a crash involves personal injury,

property damage or a stolen mini-Segway, rider shall file a report with Vancouver

police department within 24 hours.

Rider agrees that he/she is responsible and liable for any misuse, consequences,

claims, demands, cause of action, losses, liabilities, damages, costs, and

expenses, penalties, judgements, attorney’s fees, judgement, Disbursements or

suits of any kind or nature related to misuse, and or stolen mini-Segway.

Rider Responsibility for mini-Segway use & damage

Rider agrees to return the mini-Segway to operator in the same condition in

which it was rented before tour. Operator reserves the right to charge you for

damage to the mini-Segway caused by you or others, Including vandalism, water

damage, or theft, up the value of the mini-Segway ($1200 + Administration &

processing fees. Rider will not be responsible for normal wear and tear incurred

on the use of the mini-Segway.

YOUR HOME & AUTO INSURANCE POLICY MAY NOT PROVIDE

COVERAGE FOR ACCIDENTS INVOLVING OR DAMAGE TO THIS

MINI-SEGWAY.TO DETERMINE IF COVERAGE IS PROVIDED, YOU

SHOULD CONTACT YOUR INSURANCE COMPANY OR BROKER TO

THE EXTENT YOU HAVE AUTOMOTIVE OR ANY OTHER

INSURANCE THAT WOULD COVER,ANY CLAIMS,YOU AGREE

THAT SUCH INSURANCE WOULD BE PRIMARY AND NON-

CONTRIBUTOR.

Rider agrees that violations & related citation, fines or impound charges are at the

risk and expense of the rider, you shall be completely responsible and indemnify

the operator. For all tickets assessed against the mini-Segway or the operator

during the tour rental period.

PAYMENT & FEES

CREDIT CARD GENERAL

– You must provide the operator a valid credit card with

expiration date (“credit card “) before being able to use the mini-Segway. The

credit card will be verified for its validity through a pre authorization fee deposit

for the tour rental period.

METHOD OF PAYMENT

– Valid credit card ONLY, All payments made by

contactless POS machine.

GENERAL FEES

– All tours are $119 per person excluding local taxes.

All fees & transactions are in Canadian dollars. Tour

prices or availability are NOT guaranteed until full payment is received and

confirmation is sent to guest by email.

DECLINED CREDIT CARDS

– If the authorization on the credit card provided is

declined, we will attempt to notify you by email at the email address you

provided.

CANCELLATION POLICY – Vancouver wizard wheels requires 24 hrs notice

for tour rescheduling, any guest who fails to show for a reservation or fails to give

proper notice of cancellation will be charged the full payment.

INCLEMENT WEATHER – If the weather fails to cooperate and starts

raining, thundering or lightning present, We will cancel or discontinue the tour,

and you will be refunded the full payment or reschedule next available date.
